Terms and Conditions of Sale: GO2 Supplies LTD

1. Structure of the Agreement

1.1 GO2 Supplies LTD ("the Company", "we", "us") operates as a facilitator for the sale of construction materials. 1.2 We operate a dropshipping model. This means that when you ("the Customer") place an order, the goods are dispatched directly from our third-party manufacturers or distributors ("the Supplier") to you. 1.3 By placing an order, you enter into a contract of sale with GO2 Supplies LTD, but you acknowledge that the physical fulfillment and product quality are the responsibility of the Supplier.

2. Limitation of Liability and "As-Is" Provision

2.1 To the extent permitted by the Unfair Contract Terms Act 1977:

  • We exclude all liability for any indirect or consequential loss, loss of profit, or damage to property arising from the use of products.

  • Our total liability for any claim shall not exceed the price paid for the specific goods giving rise to the claim. 2.2 Death and Personal Injury: Nothing in these terms excludes our liability for death or personal injury caused by our negligence, as required by UK law. However, as we do not manufacture or handle the goods, any claims regarding product defects causing injury should be directed to the manufacturer under the Consumer Protection Act 1987.

3. Manufacturer Warranties and Defects

3.1 The Company does not provide any independent warranties. All goods are sold with the benefit of the Manufacturer’s Warranty only. 3.2 If goods are found to be defective, the Customer’s primary recourse is against the Manufacturer. We will facilitate the communication between the Customer and the Supplier to resolve the issue but do not accept liability for the defect itself. 3.3 B2B Clause: If the Customer is a business, all implied warranties regarding fitness for a particular purpose or satisfactory quality are excluded to the maximum extent permitted by law.

4. Delivery and Passing of Risk

4.1 Delivery dates are estimates only. GO2 Supplies LTD is not liable for losses caused by late delivery by the Supplier or third-party couriers. 4.2 Risk and Title: Risk in the goods passes to the Customer upon delivery. Title to the goods passes to the Customer only once GO2 Supplies LTD has received payment in full.

5. Cancellations and Returns (Consumer Rights Act 2015)

5.1 Right to Cancel: Under the Consumer Contracts Regulations, UK consumers have 14 days to cancel an order. This does not apply to:

  • Custom-made or bespoke items (e.g., cut-to-size timber or mixed paint).

  • Business-to-Business (B2B) transactions. 5.2 Returns: Goods must be returned to the Supplier’s warehouse, not the registered office of GO2 Supplies LTD. The Customer may be responsible for return shipping costs and any manufacturer-imposed restocking fees.

6. Technical Specifications and Building Regulations

6.1 It is the Customer's responsibility to ensure that any products ordered meet local UK Building Regulations and are suitable for their specific project. 6.2 We rely on data provided by Suppliers. We do not independently verify the structural integrity or fire-safety ratings of materials sold.

7. Indemnity

The Customer agrees to indemnify GO2 Supplies LTD against all liabilities, costs, and legal expenses resulting from any breach of these terms or the improper installation/misuse of products purchased through our website.

8. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
